Our website features two distinct types of imagery with different licensing terms. Please review the specific license applicable to each product before purchasing.

 

2.1 Proprietary Images (Site Owner Copyright)

Unless explicitly labeled otherwise, all original photographs, digital art, and designs created by Woolloongabba Art Gallery Pty Ltd ("Proprietary Images") are the exclusive property of the Site Owner.

  • Copyright Status: These works are fully protected by international copyright laws.License Grant: Upon purchase of a physical print of a Proprietary Image, you are granted a non-exclusive, non-transferable, perpetual license for personal, non-commercial use only.
  • Restrictions: You may not:

  • Sell, license, rent, or sub-license the print or any reproduction thereof.
  • Use the image for commercial purposes, advertising, or promotional materials without a separate written Commercial License agreement.

2.2 Creative Commons Licensed Images (CC-BY 4.0)

The primary products on this website are prints of images licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0). These images will be clearly marked with a "CC BY" badge or noted in the product description.

  • Ownership: The copyright for these images remains with the original creator (the third-party artist), not Nowhere Fast Photos.
  • License Terms: By purchasing a print of a CC-BY image, you agree to comply with the terms of the CC BY 4.0 license. See https://creativecommons.org/licenses/by/4.0/ for details,
  • Print Purchase: Purchasing the physical print grants you the physical object. Your right to reproduce or use the image digitally is governed strictly by the CC BY 4.0 license terms, not by the purchase of the print alone.

 

2.3 Digital Previews

All images displayed on the website (both Proprietary and CC-BY) are low-resolution previews for identification purposes only. Downloading, saving, or sharing these digital files for any purpose other than viewing on this site is prohibited unless explicitly authorised by the specific license terms.

 

3. Orders and Purchasing

3.1 Order Acceptance

Your order constitutes an offer to buy. We reserve the right to accept or decline your order for any reason, including but not limited to:

3.2 Pricing

4. Shipping and Delivery

4.1 Shipping Costs and Times

Shipping costs and estimated delivery times are calculated at checkout based on your location and the selected shipping method. We are not responsible for delays caused by customs, weather, or carrier issues beyond our control.

4.2 Risk of Loss

Title and risk of loss or damage to the Products pass to you upon delivery to the carrier. Once the package leaves our facility, we are not liable for lost, stolen, or damaged packages unless covered by our shipping insurance policy.

4.3 International Sales

If you are purchasing from outside Australia, you are responsible for any import duties, taxes, or customs fees levied by your country. These fees are not included in the product price or shipping cost.

 

5. Returns

If you wish to return a Product that was provided to you under these Terms and Conditions, because it is damaged, then please contact us within 7 days of delivery with photographic evidence. We will replace the item or issue a full refund.
